These Terms & Conditions apply to your use of lovermine.com (the Website) and to purchases made from Lovermine Pty Ltd ABN 93 685 259 465 (Lovermine, we, us or our).

By accessing the Website or purchasing products from us, you agree to these Terms & Conditions together with any other policies published on the Website, including our Privacy Policy, Shipping Policy and Returns Policy.

 

GENERAL

These Terms & Conditions (Terms) govern your use of the Website and your purchase of any products offered by Lovermine (Products).

Our other policies published on the Website form part of these Terms. If there is any inconsistency between these Terms and another policy, these Terms will apply to the extent of that inconsistency, unless otherwise expressly stated.

By accessing or using the Website or placing an order with us, you agree to be bound by these Terms.

We may update or amend these Terms from time to time. Any updated Terms will take effect when published on the Website. Your continued use of the Website following an update constitutes acceptance of the revised Terms.

Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted or modified.

 

ORDERS

When you place an order through the Website (Order), you are making an offer to purchase the Products included in your Order.

Your Order is accepted by us once:

(a) we have successfully received or authorised payment for your Order;

(b) we have confirmed the availability of the Products; and

(c) we have issued an order confirmation or receipt to you.

We reserve the right to accept or reject an Order for any reasonable reason, including product availability, pricing or description errors, suspected fraudulent activity or an inability to process payment.

If we are unable to fulfil an Order after payment has been received, we will refund the relevant amount using your original payment method.

 

PRICING AND PAYMENT

Prices displayed on the Website will be shown in the currency applicable to the market in which you are shopping.

Australian prices include GST where applicable.

International pricing, taxes, duties and charges will be displayed or calculated in accordance with our Shipping Policy and the destination of your Order.

Lovermine currently ships international Orders on a Delivered Duty Paid (DDP) basis where specified at checkout. This means applicable import duties and taxes are collected as part of your purchase or otherwise paid by us so that you should not be required to pay additional duties or taxes upon delivery.

Shipping charges, where applicable, are displayed during checkout.

We reserve the right to change our prices at any time without notice. Changes will not affect Orders that have already been accepted by us.

Payments are processed securely through Shopify and the payment providers made available at checkout. The available payment methods may change from time to time.

We do not directly store complete credit card details.

If a pricing error occurs on the Website, we may contact you before processing your Order and give you the option to proceed at the correct price or cancel the affected Product or Order for a full refund.

 

SHIPPING AND DELIVERY

We ship Orders to the delivery address provided by you during checkout.

Shipping methods, costs, estimated delivery times and free-shipping thresholds are set out in our Shipping Policy.

Delivery timeframes are estimates only and may be affected by circumstances outside our reasonable control, including customs delays, carrier delays, weather events, industrial action and other disruptions.

You are responsible for ensuring that your delivery information is complete and accurate.

If an Order is returned to us because an incorrect or incomplete address was provided, delivery was refused, or the parcel was not collected, we may deduct the reasonable costs associated with returning and reshipping the Order from any refund, to the extent permitted by law.

Where an Order contains multiple Products, those Products may occasionally be shipped separately.

If you believe your Order has been lost, damaged or incorrectly delivered, please write to us at love@lovermine.com.

Where a parcel is confirmed by the delivery provider as lost in transit, we will provide an appropriate remedy in accordance with applicable consumer law.

Risk in the Products passes to you when the Products are delivered to the nominated delivery address, except where applicable law provides otherwise.

 

RETURNS, EXCHANGES AND REFUNDS

Our Returns Policy forms part of these Terms and explains the eligibility requirements, timeframes, return fees and process for returning Products.

Unless a Product is faulty, damaged, incorrectly supplied or otherwise protected by applicable consumer law, returned Products must:

  • be returned within the timeframe specified in our Returns Policy;
  • be unworn, unwashed and unused;
  • have all original tags attached; and
  • be returned in their original condition.

Return shipping fees may apply as set out in our Returns Policy.

Original shipping fees are generally non-refundable unless required by law or the return results from an error by Lovermine.

Nothing in our Returns Policy or these Terms limits your rights under the Australian Consumer Law, including your rights in relation to faulty, damaged, unsafe or incorrectly described Products.

We reserve the right to refuse returns that do not comply with our Returns Policy, except where you are entitled to a remedy under applicable law.

We may also take reasonable steps to prevent fraudulent or excessive misuse of our returns process.

 

CANCELLATIONS AND ORDER CHANGES

If you need to change or cancel an Order, please write to us at love@lovermine.com as soon as possible.

We will do our best to accommodate your request, but once an Order has entered processing or has been dispatched, we may not be able to change or cancel it.

We may cancel an Order before dispatch if we are unable to supply the Product, there has been a material pricing or Website error, payment has not been successfully processed or we reasonably suspect fraudulent activity.

If we cancel an Order after receiving payment, we will refund the relevant amount to your original payment method.

 

PROMOTIONAL CODES AND OFFERS

From time to time, Lovermine may offer promotional codes, discounts or special offers (Promotions).

Promotions may be subject to additional conditions, including minimum spend requirements, eligible Products, expiry dates or geographic restrictions.

Unless otherwise stated:

  • only one promotional code may be used per Order;
  • promotional codes cannot be combined with other promotional codes or offers;
  • promotional codes have no cash value and cannot be exchanged for cash;
  • promotional codes may not apply to sale items or other excluded Products; and
  • promotional codes must be entered at checkout and cannot generally be applied retrospectively.

We reserve the right to cancel, suspend or modify a Promotion where there has been an error, unauthorised distribution, misuse, fraud or other circumstances that reasonably require us to do so.

 

GIFT CARDS

Lovermine may offer gift cards from time to time.

Gift cards may be used towards eligible purchases through the Website and are subject to any conditions provided at the time of purchase.

Gift cards will remain valid for the period required under applicable Australian law.

Gift cards cannot be exchanged or redeemed for cash except where required by law.

If the value of an Order exceeds the balance of a gift card, the remaining amount must be paid using another available payment method.

If an Order is less than the value of the gift card, the remaining balance will remain available on the gift card until used or expired in accordance with applicable law.

Gift cards may not be purchased using another gift card.

 

PRE-ORDERS

From time to time, certain Products may be offered for pre-order.

When purchasing a pre-order Product:

  • payment will be taken at the time the Order is placed unless otherwise stated;
  • the Product will be shipped at a later date;
  • estimated dispatch or delivery dates will be displayed on the relevant Product page or otherwise communicated to you; and
  • estimated dates may change due to production, freight or other circumstances outside our reasonable control.

If there is a material delay to a pre-order, we will endeavour to notify you.

Your rights to cancel or return a pre-order remain subject to these Terms, our Returns Policy and applicable consumer law.

If an Order contains both in-stock and pre-order Products, the Products may be shipped separately or together depending on the shipping method and availability.

 

YOUR RESPONSIBILITIES

When accessing the Website or purchasing Products, you agree to:

  • provide accurate, complete and current information;
  • ensure your payment and delivery details are correct;
  • keep any account login details and passwords secure;
  • use the Website only for lawful purposes;
  • follow the care instructions supplied with each Product; and
  • not use the Website or Products in a manner that infringes the rights of Lovermine or any third party.

You are responsible for activity undertaken through your account where that activity results from your failure to keep your login details secure.

 

PROHIBITED USE

You must not:

  • use the Website for an unlawful or fraudulent purpose;
  • attempt to gain unauthorised access to the Website, our systems or another customer's account;
  • introduce viruses, malware or other harmful technology;
  • interfere with the security or operation of the Website;
  • scrape, crawl, extract or reproduce substantial parts of the Website using automated means without our prior written consent;
  • use the Website to harass, threaten, defame or harm another person;
  • send unsolicited advertising, spam or promotional material through the Website; or
  • use our content, branding or intellectual property in a way that infringes our rights.

 

WEBSITE ACCESS

We may modify, suspend, withdraw or restrict access to some or all of the Website where reasonably necessary for maintenance, security, operational, legal or commercial reasons.

We do not guarantee that the Website will always be available, uninterrupted or free from technical errors.

We may also update, remove or change Website content, Products, features or functionality from time to time.

 

PRODUCTS

We make reasonable efforts to ensure that Product descriptions, photographs, measurements, colours and other information displayed on the Website are accurate.

However, colours may appear differently depending on your device, screen and display settings, and handmade, printed or natural materials may have reasonable variations between individual Products.

Product measurements are approximate and minor variations may occur.

You should follow all care instructions provided with the Product.

Nothing in these Terms excludes any guarantee, warranty or other right that applies under the Australian Consumer Law.

 

INTELLECTUAL PROPERTY

Unless otherwise stated, the Website and its contents are owned by, licensed to or authorised for use by Lovermine.

This includes, without limitation, our:

  • name and branding;

  • logos and trade marks;

  • Product designs;

  • photographs and videos;

  • graphics and artwork;

  • copy and written content;

  • Website design;

  • layouts;

  • software; and

  • other creative materials.

These materials are protected by Australian and international intellectual property laws.

LIMITED LICENSE

We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use the Website for personal, non-commercial shopping purposes.

Without our prior written consent, you must not reproduce, modify, distribute, sell, licence, publish, display, commercially exploit or create derivative works from our Website content.

You must not copy or imitate Lovermine's branding, Product imagery, designs, Website appearance or other intellectual property in a way that infringes our rights.

USER-GENERATED CONTENT

Where you submit, upload or provide content directly to Lovermine, including photographs, reviews, comments or other material, you confirm that:

  • you own the content or otherwise have the right to provide it to us;
  • the content does not infringe the rights of another person; and
  • the content is not unlawful, defamatory or misleading.

Where you expressly submit content to Lovermine for publication, you grant us a non-exclusive, worldwide, royalty-free licence to reproduce, publish and display that content for the purpose for which it was submitted.

Any broader use of customer-created content for advertising or marketing will be subject to any permissions or usage rights separately agreed with you.

 

TERMINATION

We may suspend or terminate your access to the Website if you materially breach these Terms, misuse the Website, engage in fraudulent activity or create a security risk to Lovermine or our customers.

Rights and obligations that by their nature are intended to continue after termination will survive termination.

 

LIABILITY AND CONSUMER GUARANTEES

Our Products come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, warranty, condition, right or remedy that cannot lawfully be excluded.

To the maximum extent permitted by law, Lovermine will not be liable for indirect, incidental or consequential loss arising from your use of the Website or Products where that loss was not reasonably foreseeable.

Where our liability can lawfully be limited, our liability will be limited to the remedies available under applicable law.

You are responsible for loss suffered by Lovermine to the extent that the loss results directly from your unlawful use of the Website or your material breach of these Terms.

 

THIRD-PARTY SERVICES AND LINKS

The Website may contain links to or integrations with third-party websites, services, payment providers, social networks or other platforms.

These third parties operate independently from Lovermine and may have their own terms and privacy policies.

We are not responsible for third-party websites, content or services except to the extent required by applicable law.

Your privacy is important to us.

Our Privacy Policy explains how we collect, hold, use and disclose personal information when you use the Website, purchase Products, communicate with us or interact with our marketing services.

These Terms are governed by the laws of New South Wales, Australia.

Subject to any rights you may have under applicable consumer legislation, disputes arising in connection with these Terms, the Website or Products will be subject to the jurisdiction of the courts of New South Wales, Australia.

References to dates and times on the Website are based on Sydney, Australia time unless otherwise stated.

 

SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down or severed to the extent necessary without affecting the validity or enforceability of the remaining provisions.

 

ELECTRONIC COMMUNICATIONS AND NOTICES

Where you provide us with an email address or other electronic contact details, you agree that we may communicate with you electronically regarding your account, Orders, transactions, customer service matters and other operational matters relating to the Website.

Marketing communications will be managed separately in accordance with applicable privacy and marketing laws and your communication preferences.

 

WAIVER

If we do not immediately exercise or enforce a right under these Terms, this does not mean that we have waived that right.

A waiver will only be effective where expressly provided by us.
